Problems during the construction phase of a home building contract
During the construction phase of a home building contract you can have problems where the builder is:
When these things happen you need to nip the problems in the bud immediately.
- not performing the work in a diligent and timely manner
- seeking progress payments too early, that is, before the works the subject of the progress claim are complete.
- seeking unjustified extensions of time
- performing defective work and building it in so that rectification will be inordinately expensive.
- overcharging for extras or variations
- performing work not in conformity with the plans
- seeking to charge for contract items as extras, that is, as variations.
When these things happen you need to nip the problems in the bud immediately.
